US Court Mandates Release of Kilmar Abrego Garcia from ICE Detention

Legal proceedings

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the court noted that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court proceedings center on disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

Terms of Release

The court, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now adhere to the terms of his release from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.

This decision marks a notable turn in a complex immigration battle featuring claims of wrongful detention and contested criminal associations.
